DR. Substitution, par convention ou de plein droit, d'une personne à une autre dans un rapport juridique; convention par laquelle on attribue à une chose les qualités juridiques de celle qu'elle remplace dans un patrimoine ou dans une universalité juridique. Subrogation personnelle, réelle; subrogation conventionnelle, légale. La subrogation dans les droits du créancier au profit d'une tierce personne qui le paye, est ou conventionnelle ou légale (Code civil, 1804, art. 1249, p. 225). Le contrat qui est habituellement passé entre eux [éditeur musical et compositeur] et qu'on appelle dans le langage courant une « cession en toute propriété » peut, juridiquement, s'analyser en une « subrogation conventionnelle » que le compositeur consent à l'éditeur (Civilis. écr., 1939, p. 14-14).
